These Terms and Conditions apply to every rental application submitted through the RentSetGo online application form. RentSetGo Ltd. (“RentSetGo”) acts as property manager and agent for the owner of the rental premises (the “Landlord”). In these terms, “Applicant” means each person who submits or is named on an application, and “Premises” means the rental unit applied for.
By ticking the consent box and submitting the application, each Applicant confirms that they have read, understood and agreed to these Terms and Conditions.
1. Application and Availability of the Premises
Submitting an application does not create a tenancy and does not reserve the Premises. If an application is approved, the Premises will be placed back on the available-to-rent list if the Applicant:
- fails to sign the Landlord’s Tenancy Agreement for the Premises;
- notifies the Landlord in writing that they do not intend to take occupancy; or
- provides a cheque or payment that is returned, declined or otherwise invalid.
2. Credit Investigation and Reference Checks
The Applicant consents to the Landlord, or RentSetGo on the Landlord’s behalf, conducting or arranging a credit investigation, including confirmation of employment, income and previous tenancies. The Applicant further agrees that this information may be shared with any other party with whom the Applicant has, or proposes to have, a financial relationship, including, where applicable, landlords or guarantors.
3. Collection, Use and Disclosure of Personal Information
By providing personal information on this application, the Applicant consents to its collection, use and disclosure for the purpose of applying for rental accommodation with the Landlord. The Applicant acknowledges that this information may be shared with parties related to the Landlord and with third-party service providers that assist in processing the application.
4. Use of Automated Review Tools
The Applicant acknowledges and consents that the Landlord and RentSetGo may use artificial intelligence tools, including large language models (LLMs), to review, verify and analyze the information and documents submitted with the application. These tools are used to streamline processing and to improve the speed and quality of the review.
These tools assist our staff only. Every decision on an application is made by a member of the Landlord’s or RentSetGo’s team. Information reviewed with these tools may be processed by third-party service providers bound by confidentiality and data protection obligations, and may be stored or processed outside Canada.
5. Retention and Withdrawal of Consent
The Applicant consents to the Landlord retaining the application and supporting documents until the Applicant’s account is closed. An Applicant who wishes to withdraw consent for one or more purposes must notify the Landlord in writing at the address below. Withdrawing consent may prevent the Landlord from processing the application.
6. Accuracy of Information
The Applicant confirms that the information provided in the application is complete and correct to the best of their knowledge. The Applicant further affirms that all representations made in relation to the application, including the attached income and employment verification, are true, accurate and complete to the best of their knowledge.
PLEASE NOTE THAT PROVIDING FALSE INFORMATION IS A CRIMINAL OFFENCE.
7. Fair Assessment
All applications are assessed in accordance with the Ontario Human Rights Code and the Residential Tenancies Act, 2006.
